These Terms & Conditions ("Terms") govern all services provided by Protocol Home Services, a DBA of AS Build Development LLC ("Company," "we," "us," or "our"), to clients ("you" or "Client") in Seminole County and greater Central Florida. By booking or accepting services from Protocol Home Services, you agree to these Terms in full.

1. Services & Scope of Work

Protocol Home Services provides epoxy floor coatings, polished concrete, flooring installation, and general home services in Seminole County and the greater Orlando area. All work is performed based on a written quote accepted by the Client prior to commencement.

Any changes to the scope of work after a quote has been accepted must be agreed upon in writing by both parties and may result in additional charges or adjusted timelines.


2. Estimates & Pricing

All estimates are provided free of charge following an on-site assessment. Estimates are valid for 30 days from the date of issue. After 30 days, pricing is subject to change based on material costs and availability.

Written estimates represent the anticipated cost based on conditions observed at the time of assessment. Additional charges may apply if:

  • Concealed damage, excessive moisture, or subfloor issues are discovered during work
  • The Client requests changes or additions after work has begun
  • Site conditions differ materially from those observed during the estimate

We will notify you in writing before proceeding with any work that would result in additional charges above the quoted amount.


3. Deposit & Payment Terms

✓ A 40% deposit of the total quoted job cost is required to confirm your booking and secure your scheduled date. Your date is not held until the deposit is received.

We accept payment via Stripe (credit/debit card) and Relay invoicing. Payment must be received in full before the job is considered complete and warranty coverage begins.

Deposits may be used to purchase materials, schedule subcontractors, and reserve crew time. For this reason, deposits are subject to our cancellation policy below.


4. Cancellation & Refund Policy

We understand plans change. Our cancellation policy is designed to be fair to both parties while accounting for the real costs incurred when a job is scheduled.

  • Within 3 business days of booking: Full deposit refund — no questions asked. Per Florida Statute §520.72, either party may cancel a home improvement contract within 3 business days with no penalty.
  • 4–7 days before scheduled job date: 50% of deposit refunded. The remaining 50% covers administrative costs, subcontractor scheduling fees, and material restocking where applicable.
  • Less than 72 hours before scheduled job date: Deposit is non-refundable. At this point materials have been ordered and subcontractors have been scheduled and cannot be reassigned without cost to us.
  • After materials have been ordered or installed: No refund on deposit. You will be responsible for the cost of materials purchased specifically for your job.

⚠️ If a job is cancelled after materials have been delivered to your property, you will be responsible for the full cost of those materials regardless of the cancellation timeline.

5. Scheduling & Access

The Client agrees to:

  • Ensure the work area is completely clear and accessible on the scheduled date
  • Provide access to water and electricity where required for the job
  • Remove vehicles, furniture, and personal items from the work area prior to crew arrival
  • Ensure an authorized adult (18+) is present or reachable during the job

If the work area is not ready upon crew arrival and the job cannot proceed, a $150 trip fee may be charged to reschedule. Jobs rescheduled less than 24 hours before the scheduled date are subject to a rescheduling fee.


6. Workmanship Warranty

✓ Protocol Home Services provides a 2-year limited workmanship warranty on all epoxy floor coatings and polished concrete installations from the date of job completion.

This warranty covers defects in workmanship, including:

  • Adhesion failures and delamination caused by improper application
  • Visible bubbling or peeling not caused by moisture vapor or chemical exposure
  • Significant coating separation from the substrate under normal use conditions

For flooring installation (tile, LVP, hardwood), we provide a 1-year workmanship warranty covering installation defects.

For general home services and handyman work, we provide a 90-day workmanship warranty.

Warranty claims must be submitted in writing within the warranty period with photos documenting the defect. We will inspect and remedy covered defects at no charge.


7. Satisfaction Guarantee

We stand behind every job. If you are not satisfied with the completed work, notify us within 7 days of job completion and we will return to assess and address the issue at no additional charge, provided the concern falls within the scope of the original work order.

Our satisfaction guarantee covers:

  • Workmanship issues visible at completion that were not noted in the final walkthrough
  • Areas of the job that did not meet the agreed-upon scope

The satisfaction guarantee does not cover:

  • Changes in preference after work is complete
  • Damage caused by the Client or third parties after completion
  • Natural variations in color, texture, or sheen inherent to epoxy and concrete materials

8. Warranty Exclusions

The following are explicitly excluded from all warranties and guarantees:

  • Moisture & vapor transmission: Osmotic vapor blistering, hydrostatic pressure, or moisture rising through the concrete slab — these are substrate issues beyond our control
  • Concrete movement: Cracks, settling, or movement of the underlying concrete slab
  • Chemical damage: Battery acid, brake fluid, muriatic acid, solvents, or other harsh chemicals
  • Hot tire pickup: Tire marks or staining from vehicle tires (a known characteristic of certain epoxy systems)
  • UV fading: Color change or fading from UV exposure on exterior or sun-exposed surfaces
  • Normal wear and tear: Scratches, scuffs, or surface wear from regular use
  • Client-caused damage: Damage resulting from improper use, dropped objects, or failure to follow care instructions
  • Pre-existing conditions: Damage, defects, or conditions present prior to our work and noted in the estimate

9. Use of Subcontractors

Protocol Home Services may use licensed and insured subcontractors to perform or assist in performing services. All subcontractors engaged by Protocol Home Services are required to carry general liability insurance and appropriate workers' compensation coverage or exemptions as required by Florida law.

The use of subcontractors does not affect your warranty rights or our responsibility for the quality of work delivered. Protocol Home Services remains your single point of contact and is responsible for all work performed under your job agreement.


10. Limitation of Liability

To the fullest extent permitted by Florida law, Protocol Home Services' total liability to any Client for any claim arising from services shall not exceed the total amount paid by the Client for the specific job giving rise to the claim.

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of use of property during or after the job
  • Damage to items not removed from the work area prior to our arrival, despite prior instruction
  • Pre-existing structural or substrate issues discovered during work

11. Client Property Responsibility

The Client is responsible for removing all personal property, vehicles, and sensitive items from the work area before our crew arrives. Protocol Home Services is not responsible for damage to items left in the work area. During concrete grinding and surface preparation, dust and debris are unavoidable — the Client is responsible for covering or removing any sensitive items nearby.


12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution in good faith through direct communication. If a resolution cannot be reached within 30 days, disputes shall be submitted to mediation in Seminole County, Florida before any legal action is initiated. The prevailing party in any legal proceeding shall be entitled to recover reasonable attorney's fees and costs.


13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action arising under these Terms shall be brought exclusively in the courts of Seminole County, Florida.
